Welcome to DriftBeyond.com, your premier platform for online learning, coaching, and tutoring services provided by Drift Beyond Education Inc. (hereinafter referred to as "Company," "Drift Beyond," "us," or "we"). Before you (hereinafter referred to as "User" or "you") embark on the enriching journey of utilizing our services, it is imperative that you carefully read, fully understand, and make an informed decision to accept or decline the provisions outlined in the Terms and Conditions (hereinafter referred to as "T&C") and the Privacy Policy. Minors are required to have their legal guardians accompany them when reading these terms.
TERMS AND MODIFICATION THEREOF
By reviewing these Services, you represent that you are aware of the T&C either (i) for yourself or (ii) on behalf of any minor for whom you are a parent or guardian and whom you have authorized to download, install, or use the Services. If significant changes affecting your rights are made, advanced notice will be provided via email, allowing you to review the changes before continuing to use the Services. Your continued access or use of our Services after receiving the notice of changes constitutes your acknowledgment that you accept the updated T&C.
REGISTRATION AND CONSENT
Upon agreeing to enroll in classes, acknowledge that charges may apply for missed sessions without a 24-hour cancellation notice. Should you choose to discontinue our service, kindly provide one month's advance notice and settle any outstanding fees. Any rolled-over credits from previous months may be forfeited without notice in the case of discontinuation. Your adherence to these terms ensures a smooth and mutually beneficial engagement with DriftBeyond.com.
USE OF CREDITS
If your child misses a scheduled session, the credit associated will roll over into the next month, and it will be available for use within the same academic year. To utilize accumulated credit hours, provide a minimum of 36 hours’ notice. Unused credits after one academic year will expire. Your understanding and cooperation in maximizing these resources within the specified timeframe are appreciated.
INTELLECTUAL PROPERTY RIGHT
We record sessions to track student progress and internal observations, retaining recordings for up to 30 days. Content and intellectual property rights within the Services are owned or licensed by DriftBeyond and protected by international laws. Users acknowledge no entitlement to claim rights in the Services' content. Some content is permitted for use by third parties, and DriftBeyond aims to credit them during publication.
MODIFICATION AND UPDATES
DriftBeyond, a global company with users in various time zones, reserves the right to modify, suspend, or discontinue its Services without liability. Updates and modifications may be made to enhance functionality. Agreed-upon session times may be affected by changes in daylight saving time. In the absence of a scheduled teacher, DriftBeyond may use substitute teachers. Adjustments are integral to the Services and subject to the Terms and Conditions.
EMPLOYMENT OF GLOBAL TEACHERS
We employ teachers from around the globe to address our online learners' individual personalities and needs. Therefore, your sessions may be conducted by teachers working across different time zones. This diversity enhances the quality of our education services, providing you with a personalized and enriching learning experience.
LIABILITY
DriftBeyond cannot be held liable for teachers' inability to improve students' grades. While committed to addressing learning gaps, the company is not responsible for student performance during tests, assessments, or placement exams. Additionally, DriftBeyond cannot guarantee specific grades or accepted outcomes resulting from our tutoring and coaching services.
DISCLAIMER OF WARRANTIES
DriftBeyond is not responsible for service interruptions due to technical or infrastructure-related problems. The company is not liable for the non-availability of services at any time. Users acknowledge that material or data downloaded from the services is at their own discretion and risk.
THIRD-PARTY PRODUCTS
We rely on third-party products for teaching and online sessions. In case of disruptions, DriftBeyond is not liable for associated issues. It is essential to acknowledge that third-party products may share or display content on your screen during our sessions. DriftBeyond holds no liability for the accuracy, appropriateness, or legality of the information shared by these third-party products. Users agree that the user assumes any risks associated with the use of third-party products during our sessions.
While we strive to collaborate with reputable third-party providers, DriftBeyond disclaims any responsibility for the actions, content, or security measures of these external products. Users are encouraged to review the terms and policies of these third-party products independently. DriftBeyond cannot be held accountable for any discrepancies, disruptions, or damages arising from the use of third-party products, and any issues related to these products should be directed to the respective third-party providers. USE BY MINORS
If you authorize a minor, as the parent or guardian, you assume responsibility for guiding their proper use of the Services. DriftBeyond is not responsible for any legal liabilities arising from a minor's conduct.
FORCE MAJEURE
DriftBeyond is not liable for failure to fulfill obligations due to a Force Majeure Event. Obligations will resume as soon as reasonably possible following the cessation of the Force Majeure Event.
MARKETING AND PROMOTION
During the marketing and promotion of our services, DriftBeyond may use recorded content from tutoring sessions. We will seek permission from parents before posting any pictures or videos of minors on our social media pages.
GOVERNING LAW
The T&C shall be governed by and construed in accordance with the laws of the United States.
